Minnesota Spousal Maintenance/Spousal Support
Spousal maintenance is the financial support that is paid by one spouse to the other during or after a divorce. A husband or a wife may be entitled to spousal maintenance. Spousal maintenance is based upon one party’s need for support as well as the other party’s ability to pay support while still meeting their own monthly living expenses.
The amount and duration of the support is determined by a number of factors including financial resources, age, health, duration of the marriage, and standard of living among other things. A prenuptial agreement can also determine spousal maintenance.
There is no mathematical formula that courts use to figure out an amount for spousal maintenance in Minnesota. Making a strong argument for or against support requires knowledge of the case law and a thorough analysis of the client’s circumstances.
